Abstract

This article makes an analysis of the Law N° 20.823 of 2015, amending the Labor Code regarding working hours, based on a synthesis of the history of the establishment of this law, as well a critical review of administrative jurisprudence issued in response to that legislation. In particular, the author puts into question the doctrine of the Labor Direction, consisting in the ban to unilaterally change the shift system established in the internal regulations, to adapt those to the new legislation, unless the Direction counts with the agreement of the employee
